Le preneur<br>est toujours responsable des dommages corporels et mat\u00e9riels qu&rsquo;il cause \u00e0 l&rsquo;occasion de l&rsquo;utilisation du mat\u00e9riel lou\u00e9 (art.1383 et 1384 du code civil).<\/span><\/p><p style=\"margin-bottom: 0.0001pt;background-image: initial;background-position: initial;background-size: initial;background-attachment: initial;line-height: normal\"><span style=\"font-size: 10pt;color: black\">L\u2019utilisateur est personnellement responsable de toute infraction au code de la route et il est toujours responsable des dommages corporels qu\u2019il cause \u00e0 l\u2019occasion de l\u2019utilisation du cycle dont il a la garde et ce, en quelque lieu que ce soit, en cons\u00e9quence de quoi, la responsabilit\u00e9 d\u2019Esprit Cycles ne pourra en aucun cas \u00eatre engag\u00e9e.<br>Il en est de m\u00eame pour ce qui concerne les dommages corporels et mat\u00e9riels que l\u2019utilisateur subirait en quelques raisons que ce soit.<\/span><\/p><p style=\"margin-bottom: 0.0001pt;background-image: initial;background-position: initial;background-size: initial;background-attachment: initial;line-height: normal\"><span style=\"font-size: 10pt;color: black\">&nbsp;Le client d\u00e9clare \u00eatre titulaire d\u2019une assurance personnelle, type multirisques-habitation couvrant sa responsabilit\u00e9 civile pour les risques mentionn\u00e9s ci-dessus.<\/span><\/p><p style=\"margin-bottom: 0.0001pt;background-image: initial;background-position: initial;background-size: initial;background-attachment: initial;line-height: normal\"><span style=\"font-size: 10pt;color: black\"><br>En cas de casse, l\u2019utilisateur est le seul responsable, il devra rembourser la r\u00e9paration n\u00e9cessaire \u00e0 la remise en \u00e9tat du v\u00e9lo.<br>En cas de vol ou d\u2019accident, l\u2019utilisateur doit en avertir le loueur et faire enregistrer sa d\u00e9claration par les services de police ou de Gendarmerie.<br>En cas de vol ou s\u2019il se rend responsable d\u2019un accident, l\u2019utilisateur devra r\u00e9parer le pr\u00e9judice subi par Esprit Cycles sans attendre la prise en charge par l\u2019assurance du locataire.&nbsp;<\/span><\/p><p style=\"margin-bottom: 0.0001pt;background-image: initial;background-position: initial;background-size: initial;background-attachment: initial;line-height: normal\"><span style=\"font-size: 10pt;color: black\">Remboursement au prix du neuf du v\u00e9lo vol\u00e9.<\/span><\/p><p style=\"margin-bottom: 0.0001pt;background-image: initial;background-position: initial;background-size: initial;background-attachment: initial;line-height: normal\"><span style=\"font-size: 10pt;color: black\"><br>&nbsp;Il est interdit \u00e0 l\u2019utilisateur de modifier le cycle ainsi que les accessoires et ou d\u2019y effectuer des r\u00e9parations importantes, de sous-louer le ou les v\u00e9los, de transporter un passager autre qu\u2019\u00e0 l\u2019exception d\u2019un enfant en bas \u00e2ge \u00e0 la condition qu\u2019il soit install\u00e9 dans un si\u00e8ge agr\u00e9\u00e9.<br><br><\/span><span style=\"font-size: 10pt\"><\/span><\/p><p style=\"margin-bottom: 0.0001pt;background-image: initial;background-position: initial;background-size: initial;background-attachment: initial;line-height: normal\"><span style=\"font-weight: 700\"><span style=\"font-size: 10pt\">10.
